An applicant for judicial review who delays filing for 10 months while awaiting responses from legal aid providers and dealing with overseas medical issues, without taking steps to file or serve proceedings in the interim, is unlikely to demonstrate 'special circumstances' under r 56.02(3) of the Supreme Court (General Civil Procedure) Rules 2015.
