Lay voice identification evidence under s 78 of the Evidence Act 2008 is inadmissible where the jury will hear all or the great majority of the recordings on which the witness based their opinion, as the witness is in no better position than the jury to make the comparison. Proceeds of crime charges may be joined with a conspiracy charge where the cash evidence is a material fact to the conspiracy and provides a common factual origin for both charges.
