A prosecution opening is not evidence and the failure of a complainant to give evidence in accordance with the prosecution opening cannot, without more, be used to impeach the complainant's credibility; however, defence counsel may legitimately criticise the overall strength of the prosecution case by reference to discrepancies between the opening and the evidence.
