A sentencing judge may refer to depositional material, including witness opinions expressed at committal, to convey the character of an offender's conduct without thereby going behind an agreed summary or unilaterally aggravating the factual basis of a plea, provided the material is consistent with the agreed facts and the judge's own assessment.
