Where family violence offending involves choking, an attempt to pervert the course of justice by coercing the victim to withdraw complaints, and breach of a family violence safety notice, a sentence of imprisonment with a non-parole period may be appropriate notwithstanding the offender's lack of prior criminal history and good rehabilitation prospects, and a CCO with time served may be insufficient to meet the sentencing purposes of just punishment, denunciation and deterrence.
