A trial judge must not discharge a juror under s 43 of the Juries Act 2000 (Vic) without first giving the parties an opportunity to be heard, and the playing of poor-quality recorded openings from a previous trial in lieu of oral addresses by counsel constitutes a serious irregularity occasioning a substantial miscarriage of justice.
