A court will not enforce a contractual indemnity for costs in caveat extension proceedings where the underlying liability under the contract is itself contested and subject to separate trial, and a caveator who lodges a defective absolute caveat may not obtain indemnity costs even where the opposing party's substantive opposition lacked merit.
