A circumstance of aggravation that increases the maximum penalty for an offence is not an element of the offence for the purposes of s 11(1) of the Sentencing Act 1995 (WA), and where a grounding offence for burglary is also charged separately, no penalty may be imposed on the separate charge even if the sentence would have been concurrent.
