Where a trustee successfully defends substantial claims that would have depleted trust assets, the trustee may be entitled to a partial indemnity from trust assets for its own costs even where it has been removed for breach of trust, and a costs apportionment based on a distorted characterisation of the issues in the litigation may constitute appellable error.
