A deed of settlement that is not signed by the party to be bound cannot be enforced as a deed under s 9(1) of the Property Law Act 1969 (WA), and a party seeking to enforce an unsigned deed as a contractual agreement must adduce sufficient admissible evidence of the other party's conduct evidencing an intention to be bound.
