The Court imposed a fully suspended sentence of 1 year, 10 months and 15 days' imprisonment (with 25 hours community service) for recklessly inflicting grievous bodily harm, and a 9-month good behaviour order for common assault, in circumstances involving an unprovoked nightclub assault by a 19-year-old offender with no prior criminal history, an ADHD diagnosis reducing moral culpability, and strong rehabilitation prospects. The Court applied a 25% sentencing discount through the combined operation of ss 35 and 36 of the Crimes (Sentencing) Act 2005 (ACT), reaffirming the principle from DPP v Weaver and DPP v Calhoun that where the strength of the prosecution case derives from the offender's voluntary admissions, s 35(4) should not operate to reduce the guilty plea discount, as the utilitarian value of full admissions exceeds that of a guilty plea alone. The Court also applied youth justice principles to the young adult offender, citing neurodevelopmental research that key brain regions continue developing until at least age 25.
