The Court approved a negotiated settlement in a family provision claim under s 8 of the Family Provision Act 1969 (ACT), ordering additional provision of approximately $116,000 for an adult child with significant health disabilities from an estate valued at approximately $1.2–1.5 million. The Court confirmed that where parties are legally represented and have reached agreement, the fact of settlement is a very significant matter and the information required to satisfy the court of adequacy is at the lower end of the scale, particularly for modest estates and modest adjustments. No order as to costs was made.
