The Court sentenced the offender to a total effective sentence of four years, two months and 22 days for a course of conduct involving aggravated dangerous driving, driving a stolen vehicle, driving at police, escape from arrest, drug supply and driving while disqualified, together with the imposition of the remainder of a previously suspended sentence for similar offending committed only weeks earlier. A Drug and Alcohol Treatment Order was imposed on the basis that the offender's drug dependency was strongly correlated with his offending, that he was assessed as eligible and suitable, and that the length of the custodial sentence already served and the total sentence hanging over him adequately served denunciation and deterrence. The Court applied a 25% guilty plea discount to the drug supply charge (where the case was strong but not overwhelming due to the need to infer the mental element) and a 7% discount to the remaining charges where video and police observation evidence rendered the prosecution case overwhelming under s 35(4) of the Crimes (Sentencing) Act 2005 (ACT).
