The establishment of statutory grounds for cancellation of a DATO under s 80ZE(1)(c) and (d) does not compel cancellation; the court retains a discretion to decline cancellation where changed circumstances — including the availability of residential rehabilitation, a changed attitude, and changed personal circumstances — provide a reasonable hope of rehabilitation based on a rational assessment. The court's power to extend the treatment and supervision period under s 80ZB is a relevant consideration in assessing whether the objects of the order can still be achieved.
