1Where a second breach of a good behaviour order involves serious, repeated offending of a similar nature to the primary offence, and the offender has already been warned through a prior resentencing, imposition of the primary sentence is appropriate under s 110(2) of the Crimes (Sentence Administration) Act 2005 (ACT).
2When imposing a previously suspended sentence alongside an existing sentence of imprisonment, totality and partial concurrency considerations apply both to the sentence and to the resetting of non-parole periods under s 66 of the Crimes (Sentencing) Act 2005 (ACT).
3Rehabilitative prospects, including assessed suitability for residential rehabilitation, may justify a longer supervisory period via the non-parole period even where the offender's breach history is serious.
