1A subpoena seeking personal details of a party lacks a legitimate forensic purpose where no arguable basis for relief against that party in the primary proceedings is identified; absent such purpose, the subpoena is self-evidently an abuse of process.
2Using the subpoena process to obtain personal information about a party to proceedings (such as address and contact details) to effect service amounts to an abuse of process unless the subpoena is issued for a purpose relating to the substantive proceeding.
3An application for substituted service under r 6460 of the Court Procedures Rules 2006 (ACT) requires identification of a suitable alternative address or method of service; where the applicant has positively established the proposed alternative address is no longer connected to the party, the application must fail.
