1Section 20AB(1AA)(a)(vii) of the Crimes Act 1914 (Cth) specifically contemplates drug or alcohol treatment orders, and the ACT DATO provisions give that sentencing option its content and meaning; Part IB does not create an exhaustive regime that excludes Territory alternative sentencing options expressly facilitated by s 20AB.
2The objects provision in s 80O of the Crimes (Sentencing) Act 2005 (ACT) does not introduce requirements inconsistent with s 16A of the Crimes Act 1914 (Cth); ss 19AB and 19AC have no work to do where an alternative sentence under s 20AB is imposed.
3Potential inconsistency between ACT breach provisions (s 80ZB) and the Commonwealth breach mechanism (s 20AC) does not preclude the making of a DATO in the first place; to the extent of inconsistency on breach, the Commonwealth provision prevails. The question of how breach would be managed was expressly left open.
