1Appointment as a notary public under the Notaries Public Act 1984 (ACT) requires satisfaction of the eligibility criteria in s 4 (current unrestricted practising certificate, competence to act as a notary public, and good fame and character) and compliance with the procedural requirements in s 5 (verified affidavit, service on the Attorney-General and law society, public notice, and observance of the one-month minimum before hearing).
2A practising certificate held in another Australian jurisdiction (here, New South Wales) may satisfy the requirement of holding a current unrestricted practising certificate for the purposes of s 4 of the Notaries Public Act 1984 (ACT).
