In the ACT, when sentencing for murder, subjective matters including mental illness and cognitive impairment are relevant to findings about the nature and circumstances of the offence under s 33(1)(a) of the Crimes (Sentencing) Act 2005 (ACT), and there is no legislative basis for excluding them; the NSW jurisprudence on objective seriousness and moral culpability does not apply.
