The Court imposed a total sentence of 3 years and 6 months imprisonment to be served by way of intensive correction order for possession, transmission and solicitation of child abuse material, rejecting the Crown's submission that only full-time imprisonment could achieve general deterrence. Taylor J held that the offender's exceptional rehabilitative efforts (66 therapy sessions over nearly 3 years), genuine remorse, low reoffending risk, and severe hearing impairment that would render custody more onerous justified an ICO despite the seriousness of the offending, which included paying for the production of child abuse material involving real children. The Court assessed counts 1 and 2 as below mid-range and count 3 toward the lower end of objective seriousness, applied a 25% discount for early guilty pleas, and gave limited weight to prior good character given the offender's employment with the AFP.
