The Court imposed fully suspended sentences for aggravated dangerous driving and driving unlicensed offences committed in breach of a good behaviour order attached to prior suspended sentences, and resentenced the offender for the breach offences. Baker J held that in the unusual circumstances — where the offender had demonstrated a genuine commitment to rehabilitation, had maintained significant drug abstinence, and where full-time imprisonment would jeopardise the restoration of custody of his young son from care — it was appropriate to extend a final opportunity to serve the sentence in the community. The Court restructured the prior suspended sentences by backdating minor offences and retaining only the most serious (aggravated burglaries) as operative sentences alongside the new offences, imposing an overall suspended term of two years and eight months.
