The Court applied Bugmy principles to reduce moral culpability based on the offender's disadvantaged childhood, accepted provocation under s 33(1)(q) of the Crimes (Sentencing) Act 2005 (ACT) as a mitigating factor, and treated a violent assault suffered in custody as a relevant hardship warranting moderation of the sentence. The non-parole period was set to expire on the date of sentencing, enabling immediate parole eligibility with a lengthy supervision period to support rehabilitation.
