An applicant's demonstrated impecuniosity, supported by documentary evidence such as Centrelink records, can establish a real risk of bankruptcy sufficient to warrant a stay of costs orders pending appeal, even without direct evidence of a bankruptcy notice or stated intention to pursue bankruptcy; however, whistleblower status is not a relevant consideration on a stay application.
