The Court refused an extension of time to appeal the Tribunal's non-revocation of a visa cancellation under s 501CA of the Migration Act. The Court held that the Tribunal did not err in its treatment of the 'legal consequences' consideration under paragraph 9.1 of Direction 110, as it had considered removal and the effective permanence of exclusion from Australia. The Court further held that the Tribunal's assessment of the impact on the applicant's family members was adequate and that, even if greater weight had been afforded to that factor, it would not have been material given the Tribunal's unchallenged finding of 'unacceptable' risk to the Australian community, which attracts greater weight under paragraph 7(2) of Direction 110.
