Where a confidentiality order under r 2.32 of the Federal Court Rules is sufficient to protect confidential settlement terms in an affidavit, a suppression order under s 37AF of the Federal Court of Australia Act should not be made, particularly where contravention of a s 37AF order would be an offence and potentially interested persons have not had notice of the application.
