The Court held that a single contravention of s 47(2) of the AML/CTF Act (failure to lodge a compliance report) warranted a $50,000 pecuniary penalty, rejecting both AUSTRAC's proposed $85,000 and the respondent's proposed nominal $1 penalty. Where a contravener puts capacity to pay in issue, the financial position of a parent company is relevant — not because the parent is liable for the contravention, but because it bears on the factual assessment of the contravener's asserted incapacity to pay and on deterrence where the contravener operates within a larger, internally coordinated corporate group. Non-payment of an infringement notice does not aggravate the objective seriousness of the original contravention, but the circumstances of non-payment are legitimately relevant to assessing the weight of cooperation and contrition evidence and the extent of the need for specific deterrence.
