where applicant unreasonably failed to accept offer to compromise
Quick Take
1Under r 25.14(2) of the Federal Court Rules 2011, where a respondent's offer to compromise is unreasonably refused and the applicant's proceeding is dismissed, the respondent is entitled to indemnity costs from 11:00 am on the second business day after the offer was served.
2A 'no order as to costs' order in prior proceedings means each party bears their own costs of those proceedings; it does not extinguish the underlying liability to pay one's own lawyers' fees.
3A self-represented litigant's status does not absolve them from obligations under s 37M of the Federal Court of Australia Act 1976 or from the consequences of unreasonably refusing offers to compromise.
