Although the IAA's reasoning at paragraph [8] risked conflating the separate inquiries under ss 473DD(b)(i), (b)(ii) and (a), the Court held it was possible to isolate the separate threads of reasoning and that the IAA's finding under s 473DD(a) that no exceptional circumstances existed provided a complete answer regardless of any shortcomings in the s 473DD(b) analysis. The Court also held the IAA adequately engaged with the applicant's detention-related claims, including the risk of false confession, finding the substance of the claim was identified and addressed through the IAA's general finding with reference to country information.
