The Court held that rule 13 of the Administrative Review Tribunal (Consequential and Transitional Provisions No. 1) Rules 2024 validly modified the time period in s 347(3)(a) of the Migration Act from 7 calendar days to 7 working days for persons in immigration detention, and that a notification letter stating 'seven working days' was therefore not invalid under the [name withheld] principle. The Court rejected the argument that the transitional rule-making power could not extend to jurisdictional time bars, finding 'unmistakeable clarity' in the Transitional Provisions Act authorising such modification. The Court also confirmed that a migration agent's failure to provide ImmiAccount login details and alleged inadequate representation constituted incompetence rather than fraud, insufficient to establish jurisdictional error under SZFDE principles.
