The Court held that a colour version of a photograph already before the delegate in black and white was not 'new information' under s 473DD, and that the IAA was entitled to have regard to it without needing to exercise its s 473DC power to obtain it. On the lease agreement, the IAA permissibly identified prima facie inconsistencies and concerns about whether the document was 'capable of being believed' without making a determinative credibility finding, thus not committing the CSR16 error. The Court also held that no ABT17 information gap arose where the IAA already had access to the relevant material and the country information before the delegate did not support the applicant's claim of extra-judicial lashing by the Basij.
