The Court dismissed an interlocutory application by a self-represented applicant seeking restoration of access to his employer's systems and premises, and an order restraining retaliation, pending trial of disability discrimination claims against the NDIS Quality and Safeguards Commission. The Court found no serious question to be tried regarding the access claims because the relevant acts occurred after termination of the AHRC complaint (raising jurisdictional issues under s 46PO of the AHRC Act) and the applicant lacked standing to enforce WHS Act obligations. Even assuming a serious question existed, the balance of convenience favoured refusal given medical evidence that workplace exposure risked psychological harm, the Commission's legitimate security obligations under the PSPF, and the availability of less intrusive alternatives including planned visits and standard disclosure mechanisms. The anti-retaliation order was refused for lack of clearly identifiable legal basis and unacceptable vagueness in scope.
