The Court held that the Administrative Appeals Tribunal complied with its statutory notification obligations under ss 425, 441A and 441C of the Migration Act by sending the hearing invitation to the applicant's nominated email address and residential address, notwithstanding that emails bounced back as undeliverable. The Tribunal's decision to dismiss for non-appearance under s 426A(1A)(b) and subsequently confirm under s 426A(1E) was not legally unreasonable where the applicant bore responsibility for maintaining current contact details and failed to respond to a separate email sent to an alternative address inviting him to update those details. The case was distinguished from CAM17 on the basis that the Tribunal also posted the hearing invitation and dismissal notification to the applicant's residential address.
