A referral to the Pro Bono Panel under r 7.36 UCPR may be confined to the provision of advice only (under r 7.37) where the applicant's case does not reveal merit, but the appeal is at an early stage and professional advice may lead to unnecessary or futile litigation being avoided or claims being properly pleaded if viable. A vexatious proceedings order in separate proceedings does not necessarily constrain a pro bono referral application in different proceedings.
