An order granting 'liberty to apply' in respect of a costs order does not extend the 14-day time limit under UCPR r 36.16(3A) for filing a notice of motion to vary that order, and the standard for establishing solicitor negligence based on a failure to advise that proceedings are 'hopeless and doomed to fail' is very strict.
