The Court sentenced the offender for supply of an indictable quantity of methylamphetamine (135.6g) to 18 months imprisonment served by way of Intensive Corrections Order, finding the offending fell well below mid-range given the offender's limited role as a delivery person. The Court held that the risk of institutionalisation (over 12 years incarcerated in the preceding 17 years) and the offender's recent trajectory toward rehabilitation — including compliance with the methadone program and relative abstinence from illicit substances — constituted special circumstances warranting an ICO rather than full-time detention, notwithstanding that drug supply offences ordinarily attract imprisonment. Parity with the co-offender Santa Ana was given little weight due to the substantially more serious nature of Santa Ana's offending.
