The Court imposed a 3-year Community Correction Order with 300 hours community service for possession of bestiality material and dissemination of child abuse material (text-based descriptions sent to one individual), finding both offences fell towards the low end of objective seriousness. The Court held that the s 5 threshold for imprisonment was not crossed given the offender's prior good character, good rehabilitation prospects, low reoffending risk, and the limited nature of the material, while emphasising that general deterrence and denunciation remained paramount considerations for child abuse material offences. The Court rejected the Crown's submission that prior good character should be excluded as a mitigating factor, finding nothing about the offending conduct required the absence of a criminal history to facilitate its commission.
