The Court sentenced the offender to 3 years and 2 months' imprisonment with a non-parole period of 1 year and 8 months for aggravated sexual assault of a 13-year-old victim, finding the offence fell just below mid-range objective seriousness. The Court held that the offender's intellectual disability (mild to moderate) and likely ASD and ADHD materially contributed to the offending and reduced his moral culpability, moderating the weight given to general deterrence, denunciation and specific deterrence, even though the offender had actual knowledge of the victim's non-consent. A significant departure from the statutory ratio of non-parole period to head sentence was warranted by the offender's cognitive impairments, first-time offender status, and the especially onerous nature of custody for a person with his disabilities.
