1Where a judgment incorporates an erroneous assumption of fact derived from a party's submissions that was not identified as incorrect before orders were entered, the court may rescind and amend its orders under UCPR rr 36.16(3A) and (3B) to correct the error.
2A party responsible for introducing the erroneous assumption that necessitates amendment of orders may be ordered to pay the costs of the correction application under UCPR r 42.1.
