The Court sentenced a 62-year-old institutionalised offender to 4 years and 9 months imprisonment (with a 5% utilitarian discount for a late guilty plea) for armed robbery in company under s97(2) of the Crimes Act 1900, with a non-parole period of 2 years and 6 months. The Court applied the R v Henry guideline range of 4-5 years as a starting point, found the offence aggravated by the presence of children, conditional liberty, victim vulnerability and planning, but reduced moral culpability on account of the offender's mental health conditions (Major Depressive Disorder and PTSD), childhood sexual abuse contributing to heroin addiction, and institutionalisation. A finding of special circumstances was made under s44 of the CSPA to ensure extended supervised parole, and the sentence was backdated to 7 November 2024 (rather than the arrest date of 7 May 2024) to allow partial accumulation with the revoked parole period.
