The Court sentenced an institutionalised Aboriginal offender to 4 years imprisonment (NPP 2 years 3 months) for armed robbery in company under s 97(2) Crimes Act 1900, after a 25% utilitarian discount for an early guilty plea. Applying Bugmy principles, the Court found the offender's profound childhood deprivation, removal from family, institutional sexual abuse, and resulting mental health conditions (complex PTSD, ASPD, MDD, substance use disorders) substantially reduced his moral culpability and diminished the significance of general and specific deterrence. The sentence was backdated applying totality principles to account for overlapping custodial periods, and special circumstances were found to vary the statutory ratio to allow a longer period of supervised community release.
