The Court imposed an aggregate sentence of 6 years and 2 months imprisonment with a non-parole period of 3 years and 6 months for 15 counts of break, enter and steal (with 37 Form 1 matters), backdated to 16 September 2024 to achieve partial concurrency with an existing Local Court sentence for related offending. The Court found special circumstances warranting adjustment of the statutory non-parole period ratio, based on the offender's positive engagement with the Compulsory Drug Treatment Correctional Centre program, his undiagnosed ADHD contributing to substance dependence which drove the offending, and the need for an extended parole period to support rehabilitation. The offender's deliberate operational mode of targeting commercial premises at night to avoid human contact was treated as mitigating moral culpability to some degree in the assessment of objective seriousness, though substance abuse itself was not found to mitigate objective seriousness.
