The Court dismissed both cross-claims following the earlier liability judgment and ordered JG King to pay the cross-defendants' costs on the ordinary basis up to 14 October 2024 and on an indemnity basis thereafter, based on unaccepted offers of compromise served that date. The Court rejected JG King's submission that the plaintiffs should bear the costs of the unsuccessful cross-claims, finding that the factual findings in the liability judgment meant the relationship between the plaintiffs' claim and the cross-claim was not such as to render it reasonable for the cross-claim to have been brought. The Court declined to make any costs order on the plaintiffs' claim against JG King at this stage, deferring that question until after the pending hearing on quantum.
