A development application for subdivision on land of high Aboriginal cultural heritage significance may be refused where the ACHAR focuses on scientific and visual impacts without adequately assessing the full range of tangible and intangible cultural heritage significance under the Burra Charter, and where consultation with Aboriginal knowledge holders has been inadequate, even where the land has been specifically rezoned for residential purposes and there is strategic need for flood-free housing supply.
