Even where the test of significance under s 7.3 of the Biodiversity Conservation Act 2016 (NSW) is not met, remnant critically endangered ecological community vegetation on a development site may constitute a key site constraint warranting refusal under s 4.15 of the EPA Act on the basis of adverse impact on the natural environment and site unsuitability.
