The Court approved a s 4.55(8) modification application made directly to the Court to modify a consent it had previously granted, following a conciliation conference at which the parties agreed to the modification. The Commissioner confirmed the jurisdictional prerequisites were met, including that the modified development was substantially the same as the originally approved development, and disposed of the proceedings in accordance with the parties' agreement under s 34(3) of the LEC Act without undertaking any independent merit assessment.
