The Court dismissed a non-party's application for joinder to Class 1 merit appeal proceedings concerning the Redbank Power Station biomass development. The Registrar held that the proposed contention regarding Aboriginal cultural heritage benefits from biomass sourcing was not a proper contention in proceedings where consent was sought only for the power station's use and not for the land clearing or biomass sourcing activities. The Registrar further held that the applicant for joinder's interests were not directly impacted by the proposed development and that its arrangement with the applicant was still under negotiation and uncertain, distinguishing Meriton on the facts, and also declined to make a Double Bay Marina order given TLC had already had opportunities to make submissions.
