A deed of settlement and release resolving planning proceedings in the Land and Environment Court can bar subsequent judicial review proceedings where the later proceedings relate to the same subject matter, and the Court has ancillary jurisdiction under s 16(1A) to determine the effect of the deed as a preliminary question.
