The Court found all four defendants not guilty across twelve charges of clearing native vegetation, on the basis that the prosecutor could not prove beyond reasonable doubt that the defendants cleared native vegetation in the charge areas during the charge periods. Key evidentiary issues included whether the vegetation cleared was native vegetation or weeds/regrowth, whether clearing occurred by herbicide application or mechanical means, and whether the corporate defendants caused or permitted the commission of the offences.
