A finding by a different judge in a different proceeding that evidence was inadmissible does not, without more, create a doubt or question warranting an inquiry under s 79 of the Crimes (Appeal and Review) Act 2001 (NSW), particularly where the evidence was tendered without objection and its content was agreed between the parties in the original proceedings.
