The Court held that the Court's reluctance to incorporate express 'reasonableness' qualifications into ISO/ESO conditions, on the basis that such language risks encouraging non-compliance where the subject forms their own view that a DSO has acted unreasonably. The judgment also confirms that ISO conditions should generally maintain continuity with existing ESO conditions absent justification for change, and that commencement of an ISO can be fixed to the expiration of a suspended ESO where the release date is uncertain.
